Welcome to Rueé. These Terms of Service (the “Terms”) govern your use of our website, mobile application, and related services (collectively, the “Services”), including the rental of our luxury bag products (the “Products”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please discontinue use of our Services.

1. Eligibility

You must be at least [18] years old (or the age of majority in your jurisdiction) to use the Services.

By using the Services, you represent and warrant that:

  • You have the legal capacity to enter into a binding contract.
  • All registration information you submit is truthful and accurate.
  • Your use of the Services does not violate any applicable law or regulation.

2. Account Registration

Account Creation

To rent any of our Products, you may need to create an account and provide accurate and complete information, including a valid payment method, shipping address, and billing details.

Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately if you suspect any unauthorized use.

Account Verification

Identity Verification: For first-time renters, Rueé may require you to verify your identity by submitting a government-issued ID (e.g., driver’s license). This verification is securely processed through Stripe, our trusted third-party identity-verification partner. Rueé does not directly store or access your ID images or personal data, but we may receive verification results to help protect against fraud and ensure compliance with our policies.

Fraud Detection: We use third-party payment processors and fraud-detection tools to assess risk and protect against unauthorized activity. By using the Services, you consent to the use of such tools for risk assessment and fraud prevention.

Shipping and Payment Details

Matching Name Requirement: The name on your shipping address must match the name on your payment method (e.g., credit card) to help prevent fraud. The person receiving the rental item must also match the verified ID. The rental item is non-transferable and must only be used by the verified customer.

Credit & Background Checks

We reserve the right to perform a soft pull of your credit report or conduct a background check before approving or during a rental transaction, particularly for high-value items. By using our Services, you consent to such checks. These checks are conducted in accordance with applicable laws and will be used solely for identity verification, fraud prevention, or risk-assessment purposes.

3. Rental Services

Rental Period

Our rental subscription operates on a bi-weekly cycle. The rental period begins on the day your bag is delivered and ends when the return package is scanned by the designated shipping carrier.

Rental Limit

Up to six (6) months. If you retain a Product for six months and have not returned it, we will assume you wish to keep the Product permanently. In such a case, you authorize us to charge your payment method on file for the full retail value of the Product, as determined by us.

Cancellation & Return

If you wish to end your rental, you must return the Product before the start of the next billing cycle to avoid being charged for an additional cycle. Detailed return instructions are provided with your order and on our website. You are liable for packages lost, stolen, or damaged in transit if you fail to follow return instructions or do not use our recommended label.

If you return the bag before your rental period ends, you will still be charged for that period’s rental fee (no prorated refunds).

If you are unsatisfied with the selected rental bag, you may return the Product within 24 hours of receipt; your refund (minus all shipping fees) will be processed after we receive the bag.

4. Payment & Billing

Payment Methods

By providing a payment method, you authorize us (or our third-party payment processor) to charge all applicable fees to that payment method.

Pre-Authorization Holds & Security Deposits

By renting a Product, you agree that Rueé may place a pre-authorization hold or security deposit on your payment method during the rental period. This is a standard security step to confirm your card is valid and to protect against potential loss or damage. It will be released or refunded when the Product is returned in good condition. If the item is not returned, returned late, or damaged beyond normal wear, Rueé may convert the hold into a charge up to the full retail or repair value of the Product.

Authorization for Future Charges

By completing a rental transaction, you authorize Rueé to charge your payment method on file for any additional fees that may arise, including but not limited to late returns, damage, loss or theft, or excessive cleaning costs. These charges may be applied up to 30 days after the rental period ends based on post-inspection findings.

Automatic Renewal

Your rental subscription automatically renews each bi-weekly period unless the Product is returned. The maximum rental term for any single Product is six months. If you do not return the Product by the end of the current rental period, your card on file will be charged for the next bi-weekly term. Rueé reserves the right to update fees with prior notice; continued use constitutes acceptance of the new pricing.

Closed or Canceled Cards

Continued Liability: If you close, cancel, or otherwise disable the payment card on file, you remain liable for all outstanding charges. We reserve the right to seek payment through alternative methods if your primary card is unavailable.

Late Fees & Non-Return Fees

If you fail to return the Product after cancellation or fail to communicate with us, we may charge late fees or the full replacement cost of the Product.

Debt Collection & Legal Recourse

If you fail to pay any amounts owed and remain unresponsive, we will make a reasonable effort to contact you for an alternative payment method. If we cannot collect the outstanding balance, we may refer the matter to a third-party collection agency or take legal action, which may include reporting delinquencies to credit bureaus.

5. Use of the Products

You agree to treat the Products with reasonable care. All rental items remain the sole property of Rueé. Our rental coverage extends to normal wear and tear, but you are responsible for any loss, destruction, or damage to the Products for any reason, including theft, loss, disappearance, fire, or major stains. We reserve the right to photograph the Product before and after rental to document any damage.

Normal Wear and Tear: minor stains, small rips, missing beads, stuck zippers, or other minor damage that can be easily remedied.

Beyond Normal Wear and Tear: distinct stains, strong odors, broken hardware, unrepairable scratches, or other significant damage. You authorize us to charge your payment method for repair, cleaning, or replacement costs up to the Product’s retail or comparable value at our discretion.

6. Loss, Damage, or Non-Return

Loss or Theft

If the Product is lost or stolen during your rental period, you authorize us to charge your payment method for the full replacement cost of the Product.

Non-Return

If you do not return the Product and remain unresponsive, we may charge your payment method for the full replacement cost or engage a collection agency to recover the owed amount.

Security Deposit & Pre-Authorization

We may retain or convert your security deposit or pre-authorization hold to cover the full or partial cost of the Product if it is lost, stolen, or damaged beyond repair.

Unauthorized Substitution or Swapping

You agree to return the exact Product shipped to you. Any attempt to return a different, counterfeit, or unauthorized item will be treated as a non-return. We reserve the right to charge your payment method for the full replacement cost of the original Product and may pursue legal action if necessary.

7. Intellectual Property

Ownership

All content on our website or mobile app (including text, graphics, logos, images, and software) is the property of Rueé or its licensors and is protected by copyright, trademark, and other intellectual-property laws.

Limited License

You are granted a personal, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use.

8. Disclaimer of Warranties

As-Is

Except as otherwise expressly provided, the Services and any Products provided through the Services are offered on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied.

No Guarantee

To the fullest extent permissible under applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the Services will be uninterrupted or error-free.

Condition

Cosmetic imperfections may exist from normal prior use. Bag condition ranges from excellent to fair. Colors and textures in product photos may appear slightly different in person due to screen settings, lighting, or other factors.

Brand Affiliation

We are not affiliated with, sponsored by, or endorsed by any of the brands whose products appear on our Services. All trademarks are the property of their respective owners.

Authenticity Commitment

We acquire our curated collection of luxury bags and accessories from brand stores and trusted sources worldwide. We strive to ensure each product is genuine and thoroughly verify authenticity to the best of our ability. While we take extensive measures to confirm authenticity, we cannot be held liable for disputes regarding a product’s brand authenticity. If you have concerns, contact us at contact@ruee.com.

Force Majeure

We are not liable for delays or failures due to causes beyond our reasonable control (e.g., natural disasters, carrier interruptions).

9. Limitation of Liability

Exclusion of Damages: Rueé and its directors, employees, or agents shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Services or the Products, including allergic reactions or personal injuries.

Maximum Liability: In no event shall our total liability exceed the amounts paid by you for the specific rental transaction that gave rise to the claim.

10. Arbitration & Class Action Waiver

Any dispute or claim arising out of or relating to these Terms or your use of the Services shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules.

You and Rueé each waive the right to a trial by jury and to participate in a class action or consolidated proceeding.

Either party may bring an individual claim in small-claims court if jurisdictional requirements are met.

11. Miscellaneous Provisions

Entire Agreement: These Terms, together with any policies or agreements expressly incorporated by reference, constitute the entire agreement between you and Rueé regarding your use of the Services.

Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

Headings & Interpretation: Section titles and headings are for convenience only and do not affect interpretation. “Including” means “including but not limited to.”

Reservation of Rights to Modify Services: We may change, suspend, or discontinue any aspect of the Services (including pricing or availability) at any time, and may limit the number of items a customer can rent, in our sole discretion and without notice or liability.

12. Indemnification

You agree to indemnify, defend, and hold harmless Rueé, its officers, directors, employees, agents, and affiliates from and against any and all losses, damages, liabilities, claims, or expenses (including attorneys’ fees) arising out of or related to your use of the Services or your violation of these Terms.

13. Termination

Termination by You

You may stop using the Services at any time. However, all payment and return obligations remain in effect for any outstanding rentals or fees.

Termination by Us

We may suspend or terminate your access to the Services at any time, without notice, for any reason, including if you breach these Terms or engage in fraudulent activity.

14. Modifications to the Terms

We reserve the right, at our discretion, to update or replace these Terms at any time. If a revision is material, we will notify you via email or by posting a notice on our website. Your continued use of the Services after any such change constitutes acceptance of the new Terms.

15. Governing Law & Dispute Resolution

Governing Law

These Terms and any dispute or claim arising out of or in connection with them shall be governed by the laws of California, without regard to conflict-of-law principles, unless otherwise required by your state law.

Dispute Resolution

Any disputes shall be resolved in accordance with the laws and legal proceedings of California, unless otherwise required by your state law.

BY ACCESSING OR USING OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THESE TERMS AND AGREE TO BE BOUND BY THEM.
